KILOPOP! SUES MADONNA

"if she had just asked, i suppose we would have cheerfully granted her permission to use our song and title....but she didn't, so it's up to the lawyers now".

thus spoke Furk Zhenk - the male half of the brother-&-sister Europop duo known as Kilopop!. Zhenk alleges that Madonna's new release (entitled "Hard Candy") uses substantial intellectual property 'appropriated without compensation' from his band's song "The Candy".

NR: (NOW READING)

from pal Jim Palmarini on AD Peters' rust paintings:

THIS METAL, THIS RUST, THIS LIFE
(For AP, Bro, Bwax)

Well, we are what we are
rusting or not
speeding spending and
enlivened by each other’s
stories in the goddam gapped
ridges our lives have worn
and built—who’s
breathing hard, who’s
hardly breathing, all that
news of this one or that one’s
Homeric trot and rot tale. What’s
the story? she said years back
ahead of the bell curve
and call, that sway ’n
dance backlog loose
on the realized and unintended
suitors who are us.

Take my hand—whaddya
got to lose? Time
isn’t on anyone’s side. Might’s
well keep in touch. Invention
is all we have and
I’m not interested in going
through this shit alone.

Oil on the metal.
Moon in the sky
Sunlight through the trees.
Something
in the water
for every fucking
one of us. This is all
so real I can hear it beating.
Now, who can see
in the dark—I’ll toss you
the keys to my own
personal comet, the drums
of my father, and
the only paintbrush
I never ruined
for that golden arrow. Decay
my ass. Get in the car—
we’re all going
for a ride and no metaphors
allowed. Rust never sleeps
you bet, so lock your door and
start pissing in the can. I know
I know—I ‘m going to pay
For this but I can’t stop myself—
what we talk about
is who we are. What we do
is what we know.
What I’ll remember
when I sleep is
you were there. Open up
the door—it’s me and
it’s raining and
you know what that means.

N. B. A. T. W. P. (NEVER BE AT THE WRONG PARTY):

from pal Nick Berry in NJ - i'll be doing a rare gig as Norton Antivirus this Tuesday 4/29 at 8pm at Goodbye Blue Monday, 1087 Broadway, Brooklyn, NY. Laptronics without the lap. Vaguely religious trippy noise...perfect for Born Agains on acid!

from pal Harvey Gold in OH: our friend Sally Spring (we we as Half Cleveland once gigged with in NYC and i as Harvey Gold once sat in with at yet another gig somewhere on the North Coast) has the voice of an angel, and some truly lovely songs. her boy toy, the legendary (or is it just 'dairy'?) and multi-talented Ted Lyons is a delight to listen to, watch, and meet if can (tho his bodyguards can be a little arbitrary sometimes).

anyway, they are going to be on the East Coast next week, and if you can, you should see them. you will not regret it, i promise.

all the best...

In a sane and beautiful world, "Sure Wish He Wasn't Here" would've been a huge hit.

Personally I prefer "Two Wrongs Don't Make Mister Right" from Preventive Measures - but it is a matter of taste, ja?

My friend, Liang White, grudgingly tells the story of how he ended up with that last name despite being Chinese. It turns out that when his parents - Mr. & Mrs. Wong - named him they erred because they didn't know White from Wong.

ba da boom!

they think they have a monopoly on the word 'candy' in a song?
there's no resemblance at all.
